Personal data protection principles

The Seller processes the Buyer's personal data in accordance with applicable legal regulations, i.e. Act No. 101/2001 Coll., on the protection of personal data, and from May 25, 2018 also in accordance with Regulation (EU) No. 2016/679 of the European Parliament and of the Council, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

The Seller is the controller of personal data. The Seller may entrust the processing of personal data to a third party as a processor. The Seller shall only transfer personal data to third parties to the extent necessary to fulfill the purpose of their processing, i.e. to carriers, payment system operators, or other subcontractors. The processor must comply with the protection of personal data to at least the same extent as the controller.

Personal data will not be processed outside the European Union.

Personal data processed, reason and purpose of their processing:

1. The Seller processes the following personal data of the Buyer (interested party): name and surname, residential address, identification number, tax identification number, e-mail address and telephone number. The Seller also processes data on the size of the Buyer's finger to the extent necessary for the purposes of manufacturing the ring.

2. The purpose for which the seller processes personal data is (i) processing the order, (ii) sending the goods as part of the performance of the purchase contract and (iii) sending informational emails to the seller, in particular with current news and promotional offers.

3. The lawful reason for processing personal data is (i) performance of the contract, including measures prior to performance of the contract at the request of the buyer (e.g. agreement on the specific form of the goods and the material used), (ii) the legitimate interest of the seller in providing direct marketing, and (iii) consent to sending information emails and publishing photos that the buyer sends to the seller.

Storage and processing time of personal data:

  1. The Seller processes personal data according to the method of obtaining it, either in electronic or paper form. The Seller declares that it has taken the necessary technical and organizational measures to protect and secure personal data so as to prevent its endangerment, leakage or damage.
  2. The data obtained for the purpose of fulfilling the contract will be stored by the seller for the period necessary for the fulfillment of the contract, the exercise of claims under the contract (maximum for 10 years) and legal obligations related to the concluded contract and its fulfillment, such as accounting, tax and other obligations, for the period specified by the relevant legal regulations.

Data obtained for the purpose of sending information emails and publishing photos on the seller's website based on the buyer's consent will be stored by the seller until the buyer withdraws consent.

On the website operated by the seller, third parties (in particular Google and Facebook) use cookies that store the seller's website on the buyer's device and enable the use of records of visits to the seller's website for measurement and targeting of advertising. By using the website with a browser in which cookies are set, the buyer agrees to their use. The seller does not associate information from cookies with the buyer as a specific user. Cookie preferences can be set within the buyer's browser, where they can also be completely disabled and deleted.

Buyer's rights: The Buyer has the following rights regarding personal data: (i) the right to access their personal data, including the right to request confirmation from the Seller as to whether they manage personal data and if so, what data, for what purpose, to whom they are transferred, how long they will be stored, etc., (ii) the right to correct or supplement any inaccuracies, (iii) the right to erasure, if there is (no longer) a reason for their processing, (iv) the right to raise an objection (e.g. incorrectness or illegality of data storage), (v) the right to data portability - i.e. in some cases the right to obtain their personal data from the Seller for the purpose of transferring it to another administrator, (vi) the right to raise an objection, (vii) the right to file a complaint with the supervisory authority, which in the Czech Republic is the Office for the Protection of Personal Data (www.uoou.cz).

Right to withdraw consent:

  1. If the buyer does not agree to receive information emails about news and offers, he is entitled to notify the seller of his disagreement with the sending of such emails at any time. The easiest way is to use the link contained in each information email.
  2. The withdrawal or failure to grant such consent cannot be a reason for the seller not to conclude or perform the contract.

Buyer's declaration: By sending the order, the buyer confirms that he has read the Personal Data Protection Policy and understood its content, in particular the scope of the processed personal data, the purpose and reason for this processing, is aware of his rights arising from the protection of personal data and agrees with the Personal Data Protection Policy.

If the buyer requires additional information, he can contact the seller at any time, who will provide it to him.
